Is a convicted felon allowed to have a gun or be around a gun?
Q. Recently my friends boyfriend was arrested for having possession of guns.My question:Arent there harsher charges for a convicted felon who is around guns or have a gun in their possession?They arent allowed to be around guns period,correct?Whether they are on probation or off?Felons period.Correct?Maybe its different in other states,but Im talking about the state of Indiana.

A. I have worked in a federal prison for 19 years... NO! Inmates can not be in possession of a firearm of any type either in personal possession OR in a house where a firearm is located. he does not have to have knowledge, his mere presence is enough... He can not be in possession of parts of a firearm, firing pins, slides, ammo, ANY part of a fire arm. Antique firearms that will not fire qualify for this as well... ANY felony is fair game period. A convicted felon is a convicted felon is a convicted felon... This is how a prosecutor is going to look at it. Q. My dads friend has a son that is a convicted felon, that he wants to deer hunt. Can he use a black powder gun. I don't see why he should be able to but that's my opinion.

A. It's not considered a violent crime unless he uses the firearm or threatens someone with it. Now if he is just pulled over and it found then that's not a violent crime unless of course it was used in a robbery or murder or something like that and that can be proven by ballistics. However, it is a SERIOUS offense for a parolee to be caught with a firearm and it can definitely mean prison time. The person will be very lucky if he just gets a year in the county jail.

Why is it illegal for a felon to wear body armor?
Q. I have seen this in the news twice now, in just the last week. Two separate incidences where somene was arrested because of wearing body armor. I can understand weapons, but I can't comprehend why it is illegal for a felon to posess or wear body armor. Can someone explain the origin of this federal law? Why it exists? It seems like, once a convicted felon, mended ways or not, they are no longer allowed to protect themselves. I just want to know.

A. A reasonable, average individual does not need to wear body armor. Body armor is only necessary if you believe you are going to enter into a situation where you might get shot. A felon should never willingly or knowingly enter into a situation where there might be gunfire. Most reasonable people would assume that if you are going to wear body armor it is because you are going to be involved in a situation where you might get shot at - possibly even by the police. Felons have no business being in such a situation; removing their right to wear body armor is a means of preventing them from involving themselves in such a situation. What happens when a triple felon gets caught with a stolen gun?
Q. I know someone who was involved in a near fatal car accident and he had a loaded gun with the serial numbers shaved off. The gun was not his, he got it from someone else. The person who gave it to him is a triple felon. How much trouble can they get into? I don't know if the gun was even reported stolen years ago but it can be traced back to him because we live in such a small town. Oh yeah, and he is not on probation or parole, he flattened for the previous charges.

A. He needs to ask his probation officer to apply to the Interstate Compact so that he can move to Indiana. Since he's employed in IN, it's very likely that it will get approved. There's a fee involved for the transfer application, BTW. The MI probation officer will send the paperwork to the state of MI Interstate Compact office, who will then contact the IN Interstate Compact office. The packet will be forwarded to the local county probation office, and they will make the determination as to whether or not to accept him for supervision. How far north of the border do you live? Does he have a travel permit to go to IN to work each day? Do you live in IN already?

A. If he was charged over 5 years ago and has had no trouble with the law since you should be fine. You can find all this info on the Canadian Border Services website. If its within 5 years though, sorry, they won't let you cross. In that case I would suggest you fly. Make sure you have your birth certificate and one piece of photo I.D. Of course it's good to have proof of ownership and insurance but I've crossed the border a gazillion times and never been asked this. Actually I went down to Ohio for a week and totally forgot I had an outdated insurance certificate hahaha!

A. Sadly enough this is his continued "punishment" for making the bad choices he has made. You might ask his parole/probation officer, if he has one for suggestions or maybe if this officer feels it appropriate their office could write some type of vouching letter that he is abiding by his parole agreement. That is if he even has a parole officer. PS I am not trying to make excuses for this felon, but many people don't realize we have almost ALL done something that would/could put us in prison, we just didn't get caught. A. I can't tell you every possible consequence (no firearms in the house is definitely one), but I will suggest that you check and see if your state offers a first offender's pardon. In Louisiana, a person is automatically entitled to a pardon for a first felony. Even if your state does not offer it automatically, it might be worth looking into the procedure for applying for a pardon. Congrats on your engagement. Given your education, I trust that you know what you are doing.

A. Actually, you can own it, but you cannot legally possess it. No licensed dealer can sell a gun to you, but you can inherit or by one from a private party. You can own it and have it stored somewhere, but if you possess the gun you own, or the gun you rent, or borrow or steal or find, you committ another felony.
